This Privacy Policy describes how Konsmo Media LLC, doing business as Matthew Konsmo – Coldwell Banker Danforth (“we,” “us,” or “our”), collects, uses, shares, and protects personal information when you visit www.matthewkonsmo.com (the “Site”) or interact with us in connection with real estate services.

We act as the controller of your personal data. Third-party service providers we work with assist us solely in their capacity as data processors and are contractually bound to protect your information.
We are a real estate practice licensed in Washington State, serving buyers and sellers across Western Washington including Kirkland, Woodinville, Redmond, Bellevue, Edmonds, Camano Island, and Seattle neighborhoods.

A. Information You Provide to Us
We collect personal information you voluntarily provide when you:

B. Information Collected Automatically
When you visit the Site, we and our third-party service providers may automatically collect:

C. MLS and Property Search Data
The Site may display property listings sourced from the Northwest Multiple Listing Service (NWMLS). When you interact with listing data — such as saving a property, running a search, or requesting more information — we may record that activity to provide more relevant service.
D. CRM and Communication Data
If you communicate with us by email, text, or phone, or if we use customer relationship management (CRM) tools to manage our relationship with you, we may collect and process email content and metadata, text message content and metadata, communication timestamps and history, and notes from our interactions with you. CRM data is used to maintain accurate records, facilitate follow-up, and provide personalized service.
E. Information from Third Parties
We may receive information about you from analytics providers such as Google Analytics, social media platforms if you interact with our pages, property records and public records databases, and referral partners or other real estate professionals.

- Coldwell Banker Danforth: as a licensed agent affiliated with Coldwell Banker Danforth, we may share information with our brokerage as required by Washington State law, NWMLS rules, and our franchise agreement.
- Advertising platforms: we may share limited data (such as device identifiers and browsing behavior) with platforms like Google and Meta to deliver relevant advertising and measure campaign effectiveness. We do not share phone numbers or SMS opt-in data with any third party for marketing purposes.
- Professional advisors: lawyers, accountants, or other professionals engaged in connection with our business.
- Legal requirements: if required by law, court order, or government authority, or to protect our legal rights or the safety of others.
- Business transfers: in the event of a sale, merger, or transfer of business assets, your information may be transferred. We will notify you if this occurs and your information becomes subject to a different privacy policy.

Note: opt-outs are device- and browser-specific. You will need to opt out on each browser and device you use. We do not currently respond to browser “Do Not Track” signals, but we do honor Global Privacy Control (GPC) signals where technically feasible.
7. SMS Text Messaging
A. How We Use SMS
We use SMS text messaging to confirm appointments, send reminders, and notify you of important updates. With your consent, we may also send SMS marketing messages including new listing alerts, price reduction notifications, open house invitations, and real estate market updates.
B. Consent and Data Use
By providing your mobile phone number and opting in, you consent to receive text messages from us. Consent is not a condition of using our services. We will not share your phone number or SMS consent data with any third party for marketing purposes.
C. Opting Out
Reply STOP to any SMS message at any time to unsubscribe. We will send a confirmation. You may re-subscribe at any time by contacting us.
D. Assistance and Rates
Reply HELP to any message for assistance, or email matthewkonsmo@gmail.com. Message and data rates may apply. Message frequency varies. Contact your wireless carrier for questions about your plan.
8. Your Privacy Rights
Washington State residents have the following rights under Washington privacy law:
- Access: request a copy of the personal information we hold about you
- Correction: request that we correct inaccurate or outdated personal information
- Deletion: request that we delete your personal information, subject to legal retention obligations
- Portability: receive your information in a portable, machine-readable format where technically feasible
- Opt-out of marketing: unsubscribe from marketing emails using the unsubscribe link in any email, or contact us directly
- Non-discrimination: we will not discriminate against you for exercising your privacy rights

9. Data Retention
We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Policy or as required by law:
- Contact and inquiry data: up to 3 years from last contact, or as required by Washington real estate record-keeping rules
- Transaction records: 6 years from transaction close, per Washington State real estate license law (RCW 18.85)
- CRM and communication data: for the duration of our active relationship and a reasonable period afterward
- Analytics data: as configured in our analytics platform (typically 26 months for Google Analytics)
- Marketing preferences: until you update them or opt out
When personal information is no longer needed, we securely delete or anonymize it.
10. Data Security
We implement reasonable technical and organizational measures to protect your personal information, including SSL/TLS encryption for data transmitted through the Site, password-protected systems and access controls, and regular security reviews of our website and hosting environment.
No method of transmission over the internet or electronic storage is 100% secure. While we use commercially acceptable means to protect your data, we cannot guarantee absolute security. In the event of a data breach affecting Washington State residents, we will provide notification as required by the Washington Data Breach Notification Act (RCW 19.255).
11. Third-Party Links and Services
The Site may contain links to third-party websites and services, including MLS search portals, mortgage tools, Google Maps, and social media platforms. This Privacy Policy does not apply to those third-party sites. We encourage you to review their privacy policies before sharing personal information. Third-party services we use may include Google Analytics, Google Maps, WordPress, NWMLS IDX providers, email marketing platforms, and Meta (Facebook/Instagram).
12. Children’s Privacy
The Site is not directed to children under 18 years of age. We do not knowingly collect personal information from anyone under 18. If we become aware that we have collected personal information from a minor, we will delete it promptly. 13. Fair Housing and Non-Discrimination
Konsmo Media LLC and Matthew Konsmo are committed to the Fair Housing Act, the Equal Opportunity Act, and the Washington Law Against Discrimination (RCW 49.60). We do not collect or use personal information in any manner that discriminates on the basis of race, color, national origin, religion, sex, familial status, disability, sexual orientation, gender identity, marital status, or any other protected characteristic under federal or Washington State law.
14. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we do, we will update the effective date at the top of this page. For material changes, we will provide notice on the Site or by email at least 30 days before changes take effect where feasible. Your continued use of the Site after the effective date of an updated policy constitutes your acceptance of the changes.
